			<content:encoded><![CDATA[<p>A long break, yes, and now back with some controversial posts again!</p>
<p>What do the great Greek movie, &#8220;300&#8243;, and &#8220;The Other Boleyn Girl&#8221; have in common, besides both being shown in local (Read: Malaysian) cinemas?</p>
<p>Hint: Reinforces the widely-held belief that Malaysians do favour anal sex despite very vociferous public displays of outrage over such &#8220;unnatural&#8221; sex. For your information, buggery is still an offence under the Penal Code. Yes, we, if our Censorship Board&#8217;s standards of decency is the yardstick of our society&#8217;s moral and sexual standards, do prefer illegal sex, and forced ones too. And life is much more interesting too if we get to read all about our elites&#8217; predilection for such simple pleasures.</p>
<p>Cheers to our Censorship board - porn is alive and kicking butt in our local cinema screens. I have seen it and if you are aware enough and your eyes wide open, you will see it too. Hint#2 - it was done standing &#8212; gosh, I have given the game away.</p>
<p>It&#8217;s too obvious to miss - the Queen in 300 being forced to submit to anal penetration by the King&#8217;s most bitter enemy. And again, another Queen-to-be, Ann Boleyn, being forced to submit to King Henry VIII&#8217;s long pent-up lust and frustration. What is it with Queens? Compare this with the very virginal Queen Elizabeth 1.</p>
<p>Anyway, to cut a long juicy story short, our Censorship Board finally capitulated to the public&#8217;s demand for uncensored movies. Or, did they? Perhaps, those that were censoring did not realize what the actors were doing? I leave it to the movie-goers to judge.</p>
<p>If PAS or the Muslim Religious Department (those super-snoops who think khalwat is the worst sin in Malaysia, otherwise, why not set up the SuperSnoop Squad on Corruption) did not make any noise, perhaps they missed it too? After all, since it is considered unnatural, it is only natural that people aren&#8217;t too sure what those acts involve, hence the silence. Or, perhaps, it was so artfully done that it became more of an artistic spectacle rather than a crime against public decency (on screen, in the Malaysian context of course).</p>

<p>In most laws, the highest authority, namely the minister in charge of the portfolio has unfettered discretion to grant exemptions. Here is a good reason to do so. To insist on the daughter&#8217;s attendance at NS is damaging to the girl, to say the least. Already traumatized by her brother&#8217;s death, she should not be made to go through it again. It&#8217;s natural for the parents to feel paranoid. Now is the time for Badawi to show that he is humane and human after all.</p>

<h1>NS Dept: Jane Lim must attend training</h1>
<p><strong>PETALING JAYA:</strong> Jane Lim must still attend National Service (NS) training because her brother’s death is not a valid reason for exemption.</p>
<p>NS Department director-general Datuk Abdul Hadi Awang Kechil said it had no authority to exempt the 17-year-old from the programme because her brother Ricky died nine days after his NS stint.</p>
<p>“If she wants to defer training or be exempted from the programme, she will have to submit an official request to our department according to normal procedure,” he said. Abdul Hadi said Jane could only be exempted from the programme if the reason given for her request fell under the conditions stated in the National Service Training Act.</p>
<p>On Sunday, Jane’s parents Lim Geok Kim and Meng Yeok said they would not let their only surviving child go for the training following the Ricky’s death.</p>
<p>Ricky, 20, passed away on Sept 15 after completing his three-month NS training on Sept 6.</p>
<p>The SMK Catholic High student did not complain of any illness or pain prior to his death but he did complain about the camp’s hygiene and yellowish water supply.</p>
<p>In a press statement, Abdul Hadi said Ricky attended all training modules without suffering from any health problem, except for a cough and mild fever.</p>
<p>“He followed the training as usual after receiving treatment from our medical staff,” he said.</p>
<p>He also said the Lagenda Gunung Ledang Asahan camp had received clearance from the Jasin Health Department on June 18 and was safe to be used.</p>
<p>The report also showed its water supply had been treated at the Jasin Water Supply Department in Malacca, he said.</p>
<p>In Malacca, Lim remained firm on his decision not to allow Jane to attend the training. He said he and his wife would not accept any reasons from the authorities. “We will not let her go and I don’t care what it takes. My son’s death is already totally unacceptable for us and we are sure we will not take any risk of losing my only surviving daughter, he said.</p>
<p>“I will not bother to write to apply for anything (exemption). If any warning letters (from the authority) come I will just tear it,” he said.</p>

			<content:encoded><![CDATA[<p>Everyone by now would know what ISA is. Only thing is when can ISA be used? National security. What is national security? UMNO&#8217;s survival, clearly. The arbitrary and selective arrests of media, blogger and MP is incontrovertible proof that the people that currently run this nation are bankrupt of not only decent intellectual ability but moral fibre as well. Where is that special gift that God gave to all of us &#8211;<strong> conscience? </strong>It seems that in the haze and panic of the impending takeover, the incumbent powers that be have lost all control of their normal faculties.</p>
<p>A reminder of Sect 73(1) ISA -</p>
<p>Section 73(1) Internal Security Act 1960: &#8220;<em>Any police officer may without warrant arrest and detain pending enquiries any person in respect of whom he has reason to believe that there are grounds which would justify his detention under section 8; and that he has acted or is about to act <strong>or is likely to act in any manner prejudicial to the security of Malaysia</strong> or any part thereof or to <strong>maintenance of essential services therein or to the economic life thereof.</strong></em><strong>&#8220;</strong></p>
<p>I have highlighted in bold the ones that clearly have been taken advantage of by the powers that be - by adding essential services and economic life into the list of reasons that one can be detained under the ISA, clearly the intent of the provision is to be a<strong> &#8220;CATCH-ALL&#8221; </strong>provision.</p>
<p>But that happened even in developed nations like the UK etc too. So, why are we getting all hung-up about this?</p>
<p>National or security interests always equate the security of the government of the day.  It doesn&#8217;t take a rocket scientist to see this.</p>
<p>So, we all learn a lesson today. That in order to prevent such abuses in future, the next Government of Malaysia should repeal/abolish/delete the ISA. It&#8217;s as simple as that. There is no half measure like &#8220;ISA is good but only for terrorists and not for civilians.&#8221; That inevitably leads to the slippery slope of where we draw the line.</p>
<p>Are Theresa Kok and RPK prejudicial to the economic life of Malaysia? Clearly yes (according to the powers that be).The way the provision is drafted, you can attribute all the bad things happening in the country to any vocal Malaysian not on your side.</p>
<p>Malaysia now faces the double whammy of political and economic uncertainties, in no small part contributed by these 2 unwitting heroes of the people. Yes, martyrdom has its rewards - and price.</p>
<p>Heroics aside, I personally am of the view that I am better off outside of prison than inside. Hence, here are tips to stay outside of prison even while you blog your emotions off to the whole world:</p>
<p>1.<strong> Criticize the Opposition a bit</strong> eg. why has there not been any punishment for Zulkifly yet, the firebrand PKR MP who led the storming of the Bar Council forum on Conversion to Islam - please note that the forum does not challenge Islam - more like a discussion of the challenges faced by families of those non-Malays who converted to Islam.</p>
<p><strong>2. Try to be more objective. </strong>I know it&#8217;s not easy. I face the same problem. I would love to bring down UMNO with my sword - the written word - but I keep my emotions in check when I write. I am sure there are still decent souls in UMNO. I am almost 100% sure that even within Najib&#8217;s family (including in-laws), there are those who disagree with him.  What does the CEO of CIMB think - after all Nazir Razak is Najib&#8217;s brother. Should we all then boycott CIMB?  Najib is a graduate of Nottingham University in England. Nazir is a graduate of Bristol University and later Oxbridge. Surely, there must be more sense in them????</p>
<p><strong>3. MIndset changes take time. </strong>Cultivate some patience for other races. I used to know a Malay girl - smart and wear the &#8220;tudung&#8221;. But totally into Islam. Everyone morning at work, she will read the Quran on her PC. We used to have discussions about the Quran. She has her reasons and she says she has peace from what she believes. I respect that. Call it a devious psycological play on minds, but she is still a human being, a person who has convictions for her strong beliefs in Islam.</p>
<p>I learnt tolerance for other religions from her as well as from many others from other religions. There are always the exremists within each religion. If we profess a certain religion or are atheists, we should always strive to extend tolerance to other religions too. In time, everyone will see the LIght - and the Truth shall set us free. If you feel a great urge to practise extreme speech or behaviour, then let it be &#8220;Extreme Tolerance&#8221;.  One can never get enough of that.</p>
<p><strong>4. Maintain your sense of humour.</strong> What if I were to tell you that one day, if Anwar were to become PM, he might advocate that PKR and UMNO merge. Nothing is impossible in politics. Remember that Anwar has risen to the top (almost) of UMNO, meaning simply that he is too well-versed in UMNO politics. He indeed has the advantage and will definitely make use of it.</p>
<p>Have I said it all - the theme of my message - TOLERANCE -  Only tolerance can breed patience and Patience will lead us to LOVE those who oppose us and hence they will be CHANGED. Eventually. In good time, things will change. For the better.</p>

<p>Landfill Culture is widely practiced by Malaysian regardless of race. Only certain districts in this country are clean: KLCC, Putrajaya (the Parliment House), Kiara heights and Bangsar &#038; Damansara heights (Big-Wigs&#8217; districts). The rest of Malaysia is full of rubbish and pollutions. In Malaysia, it is compulsory to throw rubbish at roadside or throw into drains. If not, you will be punished in the form of a public stoning (rather severe punishment, really) and &#8216;Dilarang Membuang Sampah&#8217; means &#8216;You&#8217;re welcome to chuck your rubbish here anyhow you like&#8217;.<br />

<p>In Malaysia, the home designere culture is based on the concept of &#8220;face&#8221; and its loss. For example, a neighbour builds a new Greco-Roman balcony. The person in question responds by hiring a group of Indonesian workers to build an equally-imposing structure in their own back yards. Two huge, symmetric columns with gold, blue, light blue, light pink, light orange etc. paint, a hugh &#8220;curly-curly&#8221; automatic gate, a Japanese pond with gargantuan man-made waterfalls, a Disneyland-themed rooftop, a Louvre-style window and numerous alarms to stop the ubiquitous miscreant from vandalising the place.</p>
<p>Invariably, after a short while, the neighbour realises his loss of face resulting from his now-inferior back yard. He then extends and expands his Greco-Roman balcony in turn with the construction of TWO ponds, TWO waterfalls, extremely-curled golden gates and so on and so forth. While the extensive renovations are taking place, they make it a point to boast about their childrens&#8217; school results, which may or may not be total fabrications, just for good measure.</p>
<p>Of course, there is a tacit understanding that approval is not needed for these renovations. While it may cost RM5000-RM10000 (bribes included) to extend the back yard, kitchen etc., an approval (or lack thereof) can be resolved with a few hundred ringgit if the local officer comes knocking.<br />

<p>Zakarian Culture is the latest trendy outlaw version of the Home Designer Culture introduced and invented by &#8216;big peoples&#8217;. This culture is no small issue, now sultan is involved and Pak Lah as well and then there was a top minister claimed that the culture involved too many temples and factories so and so that it was too big to handle. So the best way to actually get out of deep shit is to cry on television. That way people will start saying &#8220;Awwww poor thing, let him go already&#8221;. It probably worked as all he got was a slap on the wrist and nothing more.<br />

<p>Recently, blogs have been popping out left, right and center, and exposing the idiocy, corruption and incompetence of the government. Good examples of these independent news outlets are Malaysia Today and Malaysia Kini. In response, the government is now trying to censor the bloggers but fail because they are too stupid to realize that the internet is without borders and they have no jurisdiction over content stored on web servers overseas. So if you want to blog, make sure you use an international server.<br />

<p>Yes, you heard me correctly. Malaysians are some of the most confused people in the world. These are kids no more than 18yrs old dressing up like they belong in the SS. They shave their heads, wear those stormtrooper boots and have swastikas tattooed on them&#8230; sounds like your average white supremacist right? yeah right&#8230; except that these kids are MALAYS. The most important component in being a skinhead is being WHITE, but the concept seem to be lost in translation. These kids they burn the Qu&#8217;ran and during Merdeka they run around KL (a few hundred of them) robbing, looting, stealing, raping, beating, sucking, fucking up the city&#8230; so much for independence. What could cause such phenomenon? Answer: Idiotic mindset among malays that can&#8217;t see foreign culture. Semua mau ikut!<br />

At university in Singapore, he was listed as an Indian. Perhaps this explains why he became more Malay than many Malays, all the while pursuing a politics which had scant time for Malay instincts for consensus and compromise.</p>
<p>The extreme pro-Malay policies with which he was associated in the late 1960s, and which he expressed in his long-banned book, The Malay Dilemma, revealed a deep frustration with traditional Malay ways. His life has been a series of battles to impose his modernising agenda on the nation. At the same time, he has maintained some visceral anti-western feelings, more familiar in the subcontinent than in Malaysia.</p>
<p>Mahathir is full of paradoxes on racial issues. Many of his policies have had the effect of reducing the racial element in government decisions, watering down the agenda to advance Malay interests. As a result he is well regarded by many in the Chinese business community. Yet, despite his trumpeting of Asian identity, he appears ashamed to admit his Indian heritage. In his new book, A New Deal for Asia, he writes about his father in such a way as to imply that he was a Malay dedicated to the improvement of his fellow Malays rather than the hard-working Indian immigrant and government servant that he was. No mention of Mahathir’s Indian Muslim background ever appears in the media. The subject is taboo.&#8221;</p>

			<content:encoded><![CDATA[<p>&#8221; The fifth <a title="Prime Minister of Malaysia" href="http://en.wikipedia.org/wiki/Prime_Minister_of_Malaysia">Prime Minister of Malaysia</a>, <a title="Abdullah Ahmad Badawi" href="http://en.wikipedia.org/wiki/Abdullah_Ahmad_Badawi">Abdullah Ahmad Badawi</a>, went on the record in 1988 to state &#8220;If we want to save Malaysia and Umno, Dr <a title="Mahathir bin Mohamad" href="http://en.wikipedia.org/wiki/Mahathir_bin_Mohamad">Mahathir</a> (then Prime Minister) must be removed. He uses draconian laws such as the <em>Internal Security Act</em> to silence his critics.&#8221; The year before, he had also stated &#8220;Laws such as the Internal Security Act have no place in modern Malaysia. It is a draconian and barbaric law.&#8221; In 2003 when he became Prime Minister, however, Abdullah called the ISA &#8220;a necessary law,&#8221; and argued &#8220;We have never misused the Internal Security Act. All those detained under the Internal Security Act are proven threats to society.&#8221; But opposition parties believe it is a threat to Umno rather than a threat to the country. <span id="more-29"></span></p>
<p>Prior to becoming Prime Minister, Mahathir had also adhered to a critical view of the ISA. In <a title="1966" href="http://en.wikipedia.org/wiki/1966">1966</a>, when Mahathir spoke out in support of the <em>Internal Security (Amendment) Bill 1966</em> as a <a title="Backbencher" href="http://en.wikipedia.org/wiki/Backbencher">backbencher</a>, he stated that &#8220;no one in his right senses like[s] the <em>ISA</em>. It is in fact a negation of all the principles of democracy.&#8221;<sup id="cite_ref-yatim_253_4-1" class="reference"><a href="http://en.wikipedia.org/wiki/Internal_Security_Act_%28Malaysia%29#cite_note-yatim_253-4">[5]</a></sup> After becoming Prime Minister however the former premier had little if any hesitation using the law to suppressed what he termed racialism but was seen by some as a move against his political opponents, the most notable of events being the infamous <a class="mw-redirect" title="Operasi Lalang" href="http://en.wikipedia.org/wiki/Operasi_Lalang">Operasi Lalang</a> in 1987.&#8221;</p>
<p>The above are lifted from wikipedia, which as you know is the encyclopaedia of choice for millions of  Internet users worldwide.</p>
<p>Today, Anwar was reported to have said:</p>
<p>&#8220;Invoking the ISA just days before September 16 is clearly an attempt to engineer an atmosphere of fear and instability that would justify the government&#8217;s heavy-handed tactics against those aligned with the political opposition,&#8221; Anwar said in a statement issued late on Friday.&#8221; Sept 12th 2008</p>
<p>If Anwar becomes PM, will he repeal the ISA? Will he repeal sodomy provisions in the Penal Code? Will he repeal the NEP and ensure equality for all Malaysians? Will he guarantee press and Internet freedom? Will he ensure the judiciary is made up of fair-minded men and women who are immune to corruption? Will he amend the Constitution to achieve all that?</p>
<p>Anwar was Education Minister during Operation Lallang 1 in 1987. What was his response then to the mass arrests and detentions? </p>
<p>When the Malaysian judiciary was attacked in 1988 by Mahathir, what was his response?</p>
<p>What was his response when ultra right-wing Muslim PKR MP Zulkifli stormed a Bar Council forum on Islam recently, saying that Islam comes first for him? Note that the forum did not challenge Islam but discussed about the impact on the families of non-Malay converts to Islam.</p>
<p>Still, with the deteriorating conditions in Malaysia, we need someone other than from UMNO, and Anwar despite being untested viz the above, is a speck of hope. </p>
<p>Hopefully, when and if Anwar does become PM, he will free ALL ISA detainees, some of whom have been incarcerated for more than 10 years. Malaysia is one of the few countries in the world which still has detention without trial laws which more often than not is used by the government to squash dissension. </p>
<p>It is too obvious that UMNO is selectively using ISA - it is in danger of isolating itself from the rest of its component parties as well as the Opposition, not to mention most Malaysians and the international community. Even the loyal MIC man, Samy Vellu is speaking out against the arrest of Sin Chew journalist under the ISA. MCA and Gerakan have spoken out against the ISA. It seems only UMNO is alone in happily using ISA as a weapon of last resort. That is the kind of leadership UMNO has now. </p>
<p>The Great Malaysian Chess Game has just entered the End Game as of 12th Sept 2008. </p>

			<content:encoded><![CDATA[<p>UMNO may have bad PR but its chess strategies nevertheless deserve some applaud. The whole Ahmad Racist Episode is just another ploy to declare a state of Emergency in Malaysia even as Sept 16 draws near.</p>
<p>All events point to it -</p>
<p>1. 41 Barisan reps flown off to Taiwan on a study trip, a trip wholly endorsed by DPM Najib. It was timed to get them outside of the country  before Anwar could entice them to cross over.  Devastatingly simple. Even a school kid can see through it.</p>
<p>2.  Ahmad&#8217;s theatrical display of gross racism designed to whip up outrage and chaos among the races especially Malays vs Chinese. Racial riots on the cards?</p>
<p>3. The other Ahmad aka Badawi pussy-footing on what to do with his &#8220;recalcitrant&#8221; namesake. Deliberate delay which is one of lawyers&#8217; most frequent court strategies. A brainless little strategy requiring little effort which Badawi has become internationally renowned for.</p>
<p>4. Sept 10th revoke of Anwar&#8217;s bail - perhaps? A possibility to cause even more chaos.</p>
<p>5. When riots break out as they are calculated to, Badawi can then declare a state of emergency, supported by the Army Chief and Police Chief. Both Army Chief and Deputy Police Chief have already made veiled public warnings against persons &#8220;stoking racial sentiments&#8221;. Who might that be? The 2 Ahmads, Mahathir, Najib, Dr Koh, leaders of MCA and Gerakan who spoke out against &#8220;racist&#8221; Ahmad, and the alternative press&#8217; editors?</p>
<p>6. If Plan A fails to materialise (racial riots), then Plan B can be executed. Mass arrrests under ISA as happened during the 1988 Operation Lallang, under Mahathir&#8217;s leadership.  Guess what? Mahathir had reportedly re-joined UMNO just today! This is Plan B and C overlap.  It is hoped that Mahathir&#8217;s presence at this great moment of crisis would restore confidence in UMNO being on top of things (as in suppressing all dissension).  Mahathir has a great track record in cowing all his enemies. He is the best person to oversee either the 1) state of emergency or 2) Operation Lallang 2. His son is running for UMNO Youth Chief, hoping to smoothen his father&#8217;s return to politics.</p>
<p>7. End result? Anwar behind bars again. No doubt aided by the DNA Act. Sept 16th foiled. Chinese cowed again, or should I say &#8220;babi-ed&#8221; (translation - &#8220;porked&#8221;) . Resurgence of UMNO and Malay supremacy. The Malay Dilemma resolved. The rise of Mahathir and son, and other cronies. Sorry, Badawi - you failed to even orchestrate a successful racial riot. Malaysia is obviously too complicated for Badawi to govern.</p>
<p>Is it such a great tactic? Possibly, seeing that the Queen aka UMNO is constantly under check. It&#8217;s a desperate calculated move - it works 99% of the time. Desperate times call for desperate measures.</p>
<p>It worked during Sept 11, 2001 in the US. Crash some planes into the World Trade Centre and the Pentagon and you get the public crying out for justice. Enter the Patriot Act which gives massive powers to the State to invade the privacy of suspected terrorists. It&#8217;s a tired but wildly successful tactic when the State requires more powers against those whom they perceive as their enemies - and as a bonus allow them potential powers to control the entire population too.  Unlimited power in the hands of a few can only mean tyranny and loss of freedom.</p>
<p>Malaysia is straddling between the Middle and the End game in this great Chess game. Wanna bet who comes out the winner? Why not? The Sports Toto 6/52 has just reached RM20 million today, possibly the highest payout amount in its history.</p>

The irony is that Part 3 has an ending that is foretold in the book of Revelations in the Bibie.. that in the end days, we will have a chip with all our personal information embedded in our bodies. These chips can be tracked via satellite just like the current GPS navigation system. It allows our every movement and location to be tracked. The GPS in its current form, is already being used in the US to surreptitiously track the movement of criminal suspects.</p>
<p>If we break any laws/rules, the chips can be disabled so that we cannot effect any transactions since every transaction eg. ATM withdrawal, parking, purchasing things requires the chip to be enabled and functional. It&#8217;s amazing that after trying to prove that Jesus Christ in the bible is a myth in a long line of similar myths since a few thousand years before Christ, the ending ends with proof that a prophesy right from the Bible is fast becoming a reality!!<span id="more-26"></span></p>
<p>The second part tries to show how the World Trade Centre plane crash is a total fabrication, done by the US Govt in order to justify the Patriot Act which has wide powers to infringe the privacy and personal liberties of persons in the US. Strangely, in Malaysia, we did not need a man-made catastrophe like 911 to enact the ISA! It&#8217;s so much easier to fool most Malaysians, even though it&#8217;s getting a tad harder now, primarily because the powers that be are behaving so dumb ass, that even a school kid can see through them!</p>
<p>The 3rd part is the one that makes you sit up and really think. Not that we don&#8217;t know any of it. It&#8217;s already been predicted about 2000 years ago. The setting up of a central world government with one central bank, and one currency controlling everyone in the world.  Nothing new but still worth to see how they backup their claim.</p>
<p>What about the indigenous peoples from far flung corners of the world? Are we going to embed chips in them too? Of course, there are always leakages in all control systems.  The world government is not as perfect as one might like to think.</p>
<p>Still the video is a compelling watch in a meditative sort of way &#8230; at least you start seeing the big picture of where we are all heading towards.</p>

Without the benefit of the judge&#8217;s written decision, I can only say off the cuff this is the right decision.  Regardless of the potential controversy this decision might generate, all non-Muslims in Malaysia should breathe a sigh of relief.</p>

<h1 id="story_title">Kuantan Syariah Court allows convert to declare himself a non-Muslim</h1>
<p><strong>KUANTAN</strong>: The Syariah High Court here has allowed an application by a Muslim convert to declare himself as a non-Muslim.</p>
<p>Jeffrey also known as Abdullah and Or Boon Hua, 36, made the application on the grounds that he had not practised the Islamic teachings since converting to the religion 14 years ago.</p>
<p>Judge Datuk A. Rahman Yunus, said in his judgment on Monday that based on the testimonies of four witnesses, it was clear that Jeffrey was not a Muslim, having not practised the Islamic teachings since his conversion to the religion.</p>
<p>&#8220;As such, the court finds that the applicant is no longer a Muslim,&#8221; he added.</p>
<p>He ordered the Pahang Islamic Religious Council to annul Jeffrey&#8217;s certificate of conversion to Islam. Expressing regret over the matter, A. Rahman reminded Islamic missionary bodies to provide proper guidance to Muslim converts.</p>
<p>He gave Jeffrey 14 days to register his renouncement of Islam and at the same time for Islamic bodies to appeal against his decision.</p>
<p>In his statement of claim, Jeffrey, a contractor, stated that he converted to Islam only for the purpose of marrying a Muslim woman.</p>
<p>He converted to Islam on Jan 20 1994 and married the woman on Nov 16 1996.</p>
<p>He also said that after converting to Islam, and after his marriage, he did not attend any Islamic religious teachings nor was he taught the religion.</p>
<p>Jeffrey applied to leave Islam after divorcing his wife on Nov 27 2001. - Bernama</p>

			<content:encoded><![CDATA[<p><span lang="EN-US">The other day, I asked a friend, Soh Toh Mai (not her real name), whether she or her husband has ever committed a crime on Malaysian soil. A little mystified, my friend of many years nonetheless obliged me with her reply. “Of course not. Why do you ask?”</span></p>
<p><span lang="EN-US">Ignoring her question, I pestered her further with my next question. “Have you ever done the “69” position or performed fellatio on your husband?” (Fellatio: oral sex, giving head or blow job. “69” position is simultaneous oral sex between two partners).<span> </span></span></p>
<p><span lang="EN-US">She went a bit red, but knowing my habit of asking her the most outrageous of questions, complied again in the affirmative.</span></p>
<p><span lang="EN-US">“There you go. See, you <em>have</em> committed a crime! And if your husband had performed oral sex on you (cunnilingus), both of you have contravened the Malaysian Penal Code and if convicted of this crime, you are both liable to be imprisoned up to 20 years in addition to being whipped as well.”</span></p>
<p><span lang="EN-US">This time, she stared wide-eyed at me with that look that says “Are you nuts? What in the world are you harping about?”</span></p>
<p><span lang="EN-US">I proceeded to explain to her why she and her husband have all of a sudden become <em>accidental criminals</em>.<span> </span></span></p>
<p><span lang="EN-US">“Our Malaysian Penal Code makes it a crime to perform oral or anal sex, regardless of gender or consent. As long as the penis is inside the anus or mouth, it is considered a crime.”</span></p>
<p><span lang="EN-US">My friend, who by now, sported an incredulous look, shot back, “Holy Molly, these are such common and natural acts that the whole world is doing them! If this is a crime, then everyone is guilty. Everyone is a criminal!”<span> </span>I know Soh is rather prone to exaggeration whenever she is on the brink of <span> </span>spewing out some volcanic ashes and rocks. Her face was turning red and she was heaving as she ranted. <span> </span></span></p>
<p><span lang="EN-US">“Ah, but under Malaysian criminal laws, these are considered unnatural acts – carnal intercourse against the order of nature,” I responded. </span></p>
<p><span lang="EN-US">Calming down a bit, Soh thought for awhile, then said, “Whoever who created this law is a moron, perhaps someone who indulges in straight sex via missionary position only. Perhaps, someone who hails from a very conservative background.<span> </span>I pity him because he would never know the joy and ecstasy of having a<span> </span>blow job done on him. And he would never know how to satisfy his partner by giving her oral sex, or maybe he doesn’t care at all.” </span></p>
<p><span lang="EN-US">Soh shook her head and continued, “Anyway, who is going to enforce this archaic law, which is as yesterday as Victorian chastity belts. Will there be a moral squad similar to the very active and occasionally bungling <em>khalwa</em>t squad?” (<em>Khalwat</em> squad comprises of Muslim men who are recruited solely to spy on every Muslim or presumed Muslim couple’s sexual behaviour)</span></p>
<p><span lang="EN-US">In a perversely enthusiastic mood now, Soh extrapolated further the scenario – “Members of the Moral or Sodomy Squad must be trained to recognize a real and pseudo or imagined penis. With a proliferation of<span> </span>dildoes around, one could easily get mistaken about the object that enters the anus or mouth. They should carry with them tools of their trade like tape measures, cameras, x-ray binoculars and storage containers specially for semen specimens. They also must be prepared to work graveyard hours as most sodomy activities are presumed to take place at night.” </span></p>
<p><span lang="EN-US">“And if time and budget allow, they should also be trained to take DNA samples. This way, their evidence will hopefully be able to stand in court. I mean all their efforts would be wasted if it cannot stand in court, right? Why prosecute under the sodomy provisions at all if their evidences are not strong enough when challenged in court?”</span></p>
<p><span lang="EN-US">I was going to say something about privacy concerns when Soh came up with another one of her bizarre extrapolations of the sodomy laws in Malaysia – “Since the law is about justice, I am sure the authorities do not want to be seen to victimize only some sodomites. The most obvious group in society who routinely practise sodomy must be gay men. So, they should launch <em>Operasi Rainbow </em>to round up all the practicing gay men in Malaysia. Punish them to the severest extent of the law in order to deter the rest of the potential sodomites in Malaysian society. “</span></p>
<p><span lang="EN-US">Soh had no time now to catch her breath. “And while they are at it, they should recruit more executioners for Malaysian prisons due to the spike in the number of prisoners requiring to be whipped. Build more prisons as well because more than half of the Malaysian population are expected to be incarcerated for offences under Section 377 of the Penal Code”. </span></p>
<p><span lang="EN-US">“Install hidden cameras in prostitution dens or hotel rooms as well. That way, instead of putting the Sodomy Squad to work on the field with al its attendant safety risks, half of them can just sit back and relax in front of TV monitors. It’s such a cushy job (in more ways than one) that I bet many men will queue up to join. There is also the potential side income as when couples caught sodomizing might want to settle “out of court”. </span></p>
<p><span lang="EN-US">There will be many too who will protest the implementation of the sodomy laws, but according to Soh, this is the price we have to pay in order to clean up the country’s image especially in terms of sexual morality.<span> </span></span></p>
<p><span lang="EN-US">“Malaysia’s image took a severe beating when a former deputy prime minister was charged for sodomy and when a serving DPM was implicated in a murder involving a Mongolian beauty. It seems that in both cases, sodomy allegedly took place. Therefore, drastic measures are needed to show to the world that Malaysians are not a nation full of sodomites,” Soh said straight-faced. Yes, my friend Soh, is known for her double-speak. <span> </span><span> </span><span> </span></span></p>
<p><span lang="EN-US">Bugger, it’s already past bedtime. I have yet to finish the script for a documentary tentatively entitled “Kisah Benar Skuad Liwat” or “True Tales from the Sodomy Squad”. <span> </span>Before I left, I gave Soh a copy of the Malaysian Penal Code with Section 377 dog-eared for her. </span></p>
<p><strong><span style="text-decoration: underline;"><span lang="EN-US">Notes:</span></span></strong></p>
<p><span lang="EN-US">(1) Malaysia’s sodomy or &#8220;crimes against nature&#8221; law bans all oral and anal sex regardless of the gender of the parties involved. It has been criticized as an antiquated statute that intrudes into private lives. It is rarely prosecuted. </span></p>
<p><span lang="EN-US">The relevant Section 377 of the Penal Code reads: </span></p>
<p><strong><span style="font-size: 10pt; font-family: " lang="EN-US">377A.Carnal intercourse against the order of nature.</span></strong></p>
<p><span style="font-size: 10pt; font-family: " lang="EN-US">Any person who has sexual connection with another person by the introduction of the penis into the anus or mouth of the other person is said to commit carnal intercourse against the order of nature. Explanation</span></p>
<p><span style="font-size: 10pt; font-family: " lang="EN-US">Penetration is sufficient to constitute the sexual connection necessary to the offence described in this section.</span></p>
<p><strong><span style="font-size: 10pt; font-family: " lang="EN-US">377B.Punishment for committing carnal intercourse against the order of nature.</span></strong></p>
<p><span style="font-size: 10pt; font-family: " lang="EN-US">Whoever voluntarily commits carnal intercourse against the order of nature shall be punished with imprisonment for a term which may extend to twenty years, and shall also be liable to whipping.</span></p>
<p><strong><span style="font-size: 10pt; font-family: " lang="EN-US">377C. Committing carnal intercourse against the order of nature without consent, etc.</span></strong></p>
<p><span style="font-size: 10pt; font-family: " lang="EN-US">Whoever voluntarily commits carnal intercourse against the order of nature on another person without the consent, or against the will, of the other person, or by putting other person in fear of death or hurt to the person or any other person, shall be punished with imprisonment for a term of not less than five years and not more than twenty years, and shall also be liable to whipping.</span></p>
<p><span lang="EN-US">(2) In their 1977 <em>Redbook Report on Female Sexuality</em>, C. Tavris and S. Sadd found that 93% of American wives reported having engaged in cunnilingus and 91% had engaged in fellatio. They concluded from this response that, &#8220;Today it is clear that if the sexual revolution has occurred anywhere, it is in the practice and acceptance of oral sex. Among people under age twenty-five, it is virtually a universal part of the sexual relationship.&#8221; </span></p>
<p><strong><em><span lang="EN-US">That was 30 years ago in America. It is safe to say that now, for people under 50, it is universal.</span></em></strong></p>
<p class="MsoNormal"><span lang="EN-GB">(4) University of Utah law professor Terry Kogan in 1998 observed that since there are far more heterosexuals than homosexuals, and since sex research shows most heterosexuals have engaged in oral sex, it follows that heterosexual sodomy is far more prevalent than homosexual. </span></p>

			<content:encoded><![CDATA[<p>Yet again, a substantive issue of law is being dismissed on technical grounds as the <a href="http://themalaysianinsider.com/index.php/headlines/42-lead-stories/2601-renunciation-of-islam-womans-appeal-dismissed">article</a> below shows. This is the chance for the Court of Appeal to settle the issue of whether a Muslim convert can renounce Islam and revert to her original religion. Yet, instead of coming up with a precedent, the court has dismissed the case in a 2-1 majority decision on technical grounds. The grounds being that that there are 2 names stated in the appeal - one a Chinese name and the other one, a Muslim name. From the article below, it is quite clear that the 2 Malay judges are harping on this most minor of issue - it&#8217;s become almost a travesty of justice. Laughable, in fact.</p>
<p>As counsel for the appellant said, what does it matter whether the names are different as &#8220;the Chinese name and Muslim name were the same person in the appeal.&#8221;  Common sense should prevail here. Substantive issues should prevail over objections based only on form. Yes, Edmund Bon did not stick to just one name in the documents, as desired. This is something that is easily rectified and in the interest of justice, should have been allowed, so that the more substantive matter, the subject matter of the appeal can be fully argued and disposed off.</p>
<p>But instead, we have parties in this case, except the appellant, all resorting to flimsy excuses to deny this claim. We have Selangor legal advisor Datin Paduka Zauyah Be Loth Khan, representing the state, citing the same incompetency reason, to reject the appeal. So what if the appellant had used her Muslim name in her SD but signed it with her Chinese name?</p>
<p>If I had been using my Chinese name all my life to sign off all my documents and letters, am I going to change my signature just because I changed my religion? If  I do that, won&#8217;t all all my documents be invalid because the signature is different. Is there a rule in Islam that makes it mandatory for all Muslim converts to change their signatures in all official documents? Is there a rule that I can&#8217;t be a Muslim and at the same time practise my Chinese culture like reading, writing and signing off documents in Chinese?  If that is the case, then the Chinese Muslims in China are not quite the proper Muslims that they should be, going by the standards imposed here.</p>
<p>Say, my passport has my Chinese signature. When I convert to Islam, do I need to go to the Immigration Department to change my signature on my passport, or worse, be told to renew my passport based on my new name and new signature? In the process, I am charged another RM300 for the 32-page forced renewal.  Will the Immigration Department pro-rate the amount or give me a rebate, if I still have another 4 years to go before its expiry?</p>
<p>Even more ludicrous is her second argument that even if the appellant used her Muslim name in the appeal, the appeal was also incompetent because in her SD and deed poll, she stated that she was not going to use her Muslim name anymore. What sort of argument is this?  So, is she saying that because of the SD and deed poll, she is to use only her Chinese name for the court case? But then, earlier, she implied it&#8217;s not okay to sign off in Chinese and so on and so forth. Why complicate a simple matter?</p>
<p>Joining her to make a simple matter even more superficially complicated is Senior federal counsel Arik Sanusi Yeop Johari, for the NRD and the government.</p>
<p>Saying that &#8220;The right authority to determine her legal entity is the NRD based on her IC. Therefore, the appellant must get approval from the NRD to change the Muslim name to her Chinese name, which was rejected by the NRD,&#8221; he said.</p>
<p>The appellant had earlier applied to the NRD to change the name in her identity card (IC) to her original name (Chinese name). However, the NRD on Sept 18, 2003, informed her that it had no jurisdiction to approve her application unless an order of renunciation of Islam was obtained from the Syariah court.</p>
<p>It&#8217;s a chicken and egg situation, isn&#8217;t it? At the end of the day, no authority wants to deal with the matter. At each stage, the correct authority abdicated their authority and the poor woman was told to seek redress at another authority - until she has to go all the way to the Court of Appeal. After more than 5 years, the poor woman still finds herself a reluctant Muslim. A Muslim in name only as she has declared that she is living like a non-Muslim.</p>
<p>We have here a woman who was forced to convert to Islam for love or marriage. People do the darndest things for love.  If the marriage breaks down later, why shouldn&#8217;t she be allowed to leave the religion?  Of course, there are wider implications in forcing her to stay on as a Muslim. The implications go beyond the scope of this commentary.  Suffice to say that it had hit at the very heart of the non-Muslims in Malaysia.  It just doesn&#8217;t make sense, lamented a European woman who had the misfortune of marrying a Muslim man from Malaysia and later found that she could not renounce Islam after her marriage broke down.</p>
<p>A comment at the bottom of the article below indicated that Christianity also did not allow its members to leave the religion. Obviously, the person who commented on this does not have the slightest idea of what being a Christian means. There is no prohibition against leaving Christianity at all. No punishment from any earthly authority. It&#8217;s just you and God, whichever one you choose. Leave at your own peril because God will deal with you, but God is a forgiving God.</p>
<p>I do not have the benefit of reading Vincent Ng J&#8217;s dissenting views  and so, my views above is merely to draw attention to how easily the Court of Appeal sidesteps the substantive issue, resulting in an instance of injustice against a woman who was unfortunate enough to fall in love and marry a Muslim.</p>
<p><a class="contentpagetitle" href="http://themalaysianinsider.com/index.php/headlines/42-lead-stories/2601-renunciation-of-islam-womans-appeal-dismissed"> Renunciation of Islam: Woman’s appeal dismissed</a></p>
<p>PUTRAJAYA, Aug 5 — A woman who converted to Islam failed today in her appeal before the Court of Appeal against the High Court&#8217;s refusal to allow her application for a declaration that she had the right to renounce Islam and embrace Christianity.</p>
<p>Justice Datuk Tengku Baharudin Shah Tengku Mahmud in a 2-1 majority decision said the appeal brought by the 35-year-old woman was incompetent before the court as the person (appellant) named in the originating summons at the High Court stage no longer existed — she had changed her name to a Muslim one.</p>
<p>Justice Tengku Baharudin, who presided over the hearing with Justices Datuk Vincent Ng and Datuk Sulong Mat Jeraie, dismissed the appeal with no costs.</p>
<p>In the originating summons at the High Court stage, she had stated her original Chinese name in the application, but the name had been changed to a Muslim name after she had converted to Islam.</p>
<p>On Feb 15, 2005, the woman in an amended originating summons sought, among others, declarations from the High Court that she had the right to renounce Islam and practise the Christian religion under Article 11 of the Federal Constitution and that she could delete her Muslim name and substitute it with her original name.</p>
<p>She named the Selangor Religious Affairs Council, Selangor Religious Affairs Department, Selangor government, the National Registration Department (NRD) director-general and Malaysian government as respondents.</p>
<p>On May 17, 2005, the Shah Alam High Court allowed the respondents&#8217; application to strike out her application on the basis that the High Court had no jurisdiction to hear and decide on the matter, and it also did not hear or adjudicate on the merits of the originating summons.</p>
<p>The woman in the summons said she embraced Islam in 1992 and changed her name to a Muslim name, and two years later she married a Malay man and was divorced in 1997.</p>
<p>She contended that after converting to Islam, she did not practise the tenets of the religion and her conversion was purely for the purpose of marrying the man.</p>
<p>On June 9, 2003, through a deed poll and statutory declaration (SD), she affirmed that she had embraced Christianity and had reverted to using her original Chinese name.</p>
<p>The  woman then applied to the NRD to change the name in her identity card (IC) to her original name (Chinese name). However, the NRD on Sept 18, 2003, informed her that it had no jurisdiction to approve her application unless an order of renunciation of Islam was obtained from the Syariah court.</p>
<p>At today&#8217;s proceeding, Justice Tengku Baharudin questioned the parties on whether the woman&#8217;s appeal was competent before the court as two names – the Chinese and Muslim names – were stated in her appeal.</p>
<p>&#8220;The question before us is who is appearing in the appeal. Is it the Chinese name or the Muslim name?&#8221; added Justice Sulong.</p>
<p>Counsel Edmund Bon, representing the woman, submitted that the appeal was competent as the Chinese name and Muslim name were the same person in the appeal.</p>
<p>&#8220;There is no dispute as to the identity of the appellant. There is no confusion because the appellant is the same person as the name stated in the appeal application,&#8221; he said.</p>
<p>Bon submitted that the appellant was a legal and natural person, and a Malaysian citizen who sought a legal remedy in the Court of Appeal.</p>
<p>Selangor legal advisor Datin Paduka Zauyah Be Loth Khan, representing the state, submitted that the appeal was incompetent because the appellant in her  SD had used her Muslim name but when she signed the SD, she used her Chinese name.</p>
<p>Zauyah said even if the appellant used her Muslim name in the appeal, the appeal was also incompetent because in her SD and deed poll, she stated that she was not going to use her Muslim name anymore.</p>
<p>Senior federal counsel Arik Sanusi Yeop Johari, for the NRD and the government, submitted that the appellant had produced the documents with two names stated.</p>
<p>&#8220;The right authority to determine her legal entity is the NRD based on her IC. Therefore, the appellant must get approval from the NRD to change the Muslim name to her Chinese name, which was rejected by the NRD,&#8221; he said.</p>
<p>Meanwhile, outside the court, Bon had asked the media not to divulge the name of the woman for safety reasons.  — Bernama</p>

<p>I have heard about the turncoat Dr Chandra Muzaffar but had never paid much attention to him - until today, 9<sup>th</sup> August 2008. The way <em>The Star</em> newspaper quoted him elicited an immediate incredulous response in me - had this guy been asleep all this while? He speaks like he has been sleeping at the ivory tower for a long time and is not familiar with the voices of dissatisfaction on the ground. He uses fancy concepts to try to project a respectable image when in fact, his views are totally one-sided. I now believe strongly that he is being used as a spin doctor by the ruling elite. And his views are the kinds of views that government-linked newspapers have for years dumped on the largely silent Malaysian public. These are the very kinds of  views and sentiment that had held sway in Malaysia for the past 30 years.</p>
<p>Before the Internet opened the eyes of Malaysians, perhaps more would have believed him, but now with the Internet exposing alternative takes on the same sets of circumstances as well as independent views by independent-thinking and concerned individuals, his views have attained the status of  &#8220;very yesterday&#8221; in today&#8217;s youth-speak.</p>
<p>Here is my dissection of what he had been quoted to have said.  His words which I find objectionable are in red while my response is in blue.</p>
<p><strong>Chandra: Bid to become PM by inciting crossovers unethical</strong></p>
<p>1)     KUALA LUMPUR: Political scientist Dr Chandra Muzaffar said that Datuk Seri Anwar Ibrahim&#8217;s attempt to become the prime minister through the &#8220;back door&#8221; by instigating massive crossovers was both unethical and undemocratic.</p>
<p><span style="color: #ff0000;">&#8220;A Cabinet established through such an avenue will lack moral credibility. Parliament itself will be tarnished. Both the Executive and the Legislature, the two vital arms of governance, will be perceived by the people as institutions that are bereft of integrity</span>,&#8221; he said.</p>
<p><span style="color: #003366;">H</span><span style="color: #003366;">as Chandra not heard of money politics?  He is a political scientist, yet, isn&#8217;t he aware that UMNO with so much money and a massive electoral machinery as well as allegations of electoral fraud still lost the majority. Had UMNO not used money politics, and had they practised fair play (but then fair play is a foreign word in politics), they would have surely lost by a majority. In effect, despite their zealous efforts in skewing the results, they have only managed a bare majority.</span></p>
<p><span style="color: #003366;">Thus, they have effectively lost the general elections. Yet, they are still in government today. They are the ones who are bereft of integrity. Parliament is already tarnished by their presence. On top of that, parliamentarians are slugging it out, both sides resorting to cheap drama to get some air time, bolstered by their Parliamentary immunity. MPs or rather MMPs (Moronic Members of Parliament) say the most incredulous things in Parliament. Parliament in Malaysia is not the haloed institution that they are supposed to be. Instead, they are platforms for some MMPs to display their powers of superior idiocy and arrogance. Public perception of Parliament is at an all-time low.</span></p>
<p><span style="color: #003366;">Both the Executive and the Legislative are already bereft of integrity and moral credibility. Rocked by scandal after scandal, with ongoing trials involving the current and former deputy prime ministers, credibility of most politicians are at an all-time low in Malaysian history. We have politicians involved in sex scandals, money politics, corruption all still running or thinking of running the show. The people are despairing that there is no one good enough to govern this country.</span></p>
<p>2)     I<span style="color: #ff0000;">n a nutshell, acquiring power through the back door would &#8220;demean and denigrate&#8221; politics, he said, adding that Anwar also had no mandate to oust the democratically elected government of the day.</span></p>
<p><span style="color: #003366;">&#8220;<span style="color: #008080;">Demean and denigrate&#8221; politics?  Politics is a dirty game. Everyone knows that. Its status is already demeaned and denigrated. Is Chandra trying to say that politics is on the same level as say, charity and rescue organizations, or even the SPCA? Anything goes in politics. Many in politics believe in achieving their ambitions &#8220;by hook or by crook&#8221;. Respectability is at an all-time low. People want a change. They want an alternative government who can change the status quo. People are fed up with the status quo.</span></span></p>
<p><span style="color: #008080;">No mandate to oust the democratically elected government of the day?  See response in (1) above. The democratic election process is suspect in Malaysia, much more so, in the case of the incumbent government prior to the elections. As stated above, if you discount all the hanky-panky that the incumbent government played, they would have lost by a majority.</span></p>
<p><span style="color: #008080;">In an ideal environment where money politics and machinations are at a minimum, Chandra&#8217;s statement would be valid. But in unusual times like these, some exceptions have to be allowed.  One has to be flexible and adapt to an ever-changing environment, thus Anwar&#8217;s mandate is implied from unusual circumstances viz. Unfair win at the elections on the part of the incumbent government.</span></p>
<p><span style="color: #008080;">It&#8217;s a bit like Thailand in September 2006 when a military coup took over the Thaksin government to the delight of many Thais. Thais were then fed up with the Thaksin government and wanted a change. The coup was legitimized through popular approval. Thus in exceptional circumstances, the laws had to be responsive and bend backwards. Laws are made to serve the people and not to oppress them. The people should not be servants of the law but the laws should respond to new sets of situations. In plainspeak, it is called discretionary application of the law.</span></p>
<p><span style="color: #ff0000;">3) Anwar, he claimed, was consumed by a single-minded obsession to become the country&#8217;s prime minister in the shortest possible time.</span></p>
<p><span style="color: #ff0000;">Hence, his concerted endeavour to persuade Barisan Nasional lawmakers in Parliament, at least 30 of them, to cross over to Parti Keadilan Rakyat (PKR), the former PKR deputy president told Bernama.</span></p>
<p><span style="color: #ff0000;">&#8220;Has there ever been an instance anywhere in the world where a government which has 58 seats more than the combined Opposition is under constant threat of imminent collapse simply because an individual who is not even in Parliament boasts continuously that a certain number of MPs are going to switch sides by a certain date?&#8221; asked Dr Chandra.</span></p>
<p><span style="color: #008080;">Well, there you go. In unusual times such as these, anything goes. I detect a  whiff of desperation in the above statement. Why does Chandra care what happens in other parts of the world? After all, a Malaysian government minister has already told other countries, namely the US, to mind their own business and not to meddle with our internal affairs. So, why would Chandra want to compare with other countries? Let us do our own thing here. We are unique and there is no other country like us.. Uniquely Malaysia.</span></p>
<p><span style="color: #ff0000;">4)     He said it was this incessant drive to topple the Government through crossovers that had created so much uncertainty in the country in the last few months.</span></p>
<p><span style="color: #008080;">In fact, the uncertainty in the country is caused by some government fixtures aka long-time ministers staying beyond their welcome. They should have left long time ago and let more progressive people run the country. I don&#8217;t hear Chandra advocating the US presidential system, where there is a limit to the number of terms each president can stay on, thus effectively minimizing the risk of dictatorship or perpetuation of a corrupt regime.</span></p>
<p><span style="color: #008080;">5)     &#8220;<span style="color: #ff0000;">If the threat of crossovers hangs like a Sword of Damocles over the nation&#8217;s head, it is partly because many Malaysians know that Anwar, as a BN and federal government leader at one time, had played a pivotal role in the overthrow of the democratically elected PBS state government in Sabah in 1994.</span>&#8220;</span></p>
<p><span style="color: #008080;">That in plainspeak is history. The bigger Sword of Damocles is whether there will be &#8220;unholy alliances&#8221; especially between UMNO and PAS, and whether the new regime will be able to deliver a &#8220;Malaysia for all Malaysians&#8221;. Treating all Malaysian citizens on an equal footing regardless of race and religion is a bigger challenge.</span></p>
<p>6<span style="color: #ff0000;">)     Dr Chandra stressed that although Anwar had stated his enticement did not involve money or other allurements, it would still be morally wrong for a legislator to cross over since it would be a betrayal of the voters trust.</span></p>
<p><span style="color: #ff0000;">&#8220;In a democracy, a legislator elected on a particular platform should return his mandate to the people and resign his seat before he switches sides. That is what respect for the dignity of the voter means,&#8221; he said.</span></p>
<p><span style="color: #008080;">The moral argument has been dealt with in (1) and (2) above. Some voters are bought. So, what voter trust are we talking about? The betrayal is more on the part of the voters rather than the MPs themselves. Can you trust a voter who can be bought? What happens when the other party pays the voter even more money to vote for them? Will the voter you have bought betray you and vote for the other party instead, even though you have paid him some money to vote for you?  Finally, what does Chandra mean by &#8220;dignity of the voter&#8221;?</span></p>

			<content:encoded><![CDATA[<p>Former prime minister, Tun Mahathir, an Indian Muslim, otherwise known as mamak, despite his smiling demeanour and short stature, had giant ambitions for the country. In order to realize his ambitions, he needed complete control of all branches of government. And he did precisely that, trampling on all institutions held sacrosanct to that point. Operation Lalang and other machinations to oust powerful personalities deemed a threat to his monopoly on power succeeded beyond his expectations. To hell with international condemnations, he will do it his way. Not surprisingly, he once admitted that his favourite song is Frank Sinatra&#8217;s &#8220;<strong><em>My Way</em></strong>&#8220;.</p>
<p>Nothing could stand in the way of <em>Mahathirism</em> - big corruption, big controversies, big cockiness, big headedness, big talk, big cronies, big projects, big buildings. Mahathir&#8217;s legacy has left a country suffering from identity crisis, a nation torn apart from strife among cronies and former cronies, all clambering for the pot of gold at the top. Anwar is by far the most resilient. Despite the ultimate humiliation of being imprisoned for &#8220;alleged&#8221; corruption and sodomy, he has held steady after being released.</p>
<p>His steady hand and single-minded purpose were cited as some of the top factors that largely contributed to Barisan not getting its expected two-thirds majority after the March 8th general election. Things looked unstoppable for him in his march to Parliament - until the appearance of what is the now billed, the <em>most talked-about ass in the country</em><strong>. </strong></p>
<p>Since then, you can see a bit of cracks in the united opposition front. Aside from the squabbles normally associated with a change of government at the state level, some disturbing trends are beginning to emerge.</p>
<p>A young female journalist was assaulted by a group of PKR (Pakatan Rakyat) supporters for merely moving too close to Anwar to take a photo. That in itself is bad enough. But the crucial point that was missed out in all the English dailies and even most of the famous political blogs was this: a group of men assaulting a young woman on the flimsiest of excuses. Where is the decency in all this? Had the victim been a man, the action would still be strongly condemned. But, a young woman? Clearly, the ground supporters have to be trained properly. Was an investigation initiated after that? What was the real cause of that uncalled-for attack?</p>
<p>But nothing was as important as damage control. Public perception is paramount. No one but from the very top was good enough to make amends - so, it had to be Wan Azizah who had to make a very public apology to the victim. Sighs of relief after that and hopefully the incident is erased from the memory of all Malaysians. Does this trend sound all too familiar? Granted, there might be some agent provocateurs in all these. In fact, I won&#8217;t assume that there are. I am sure that there are. Just as Anwar openly admitted that he has his own people in the Attorney General&#8217;s chambers, it is nothing surprising that UMNO also has their own people in PKR, perhaps some at high levels.</p>
<p><em>Notably, in Malaysia, there is a trend of a group of young men pouncing on a helpless and woefully outnumbered victim. Remember the case of a young law student bludgeoned to death in a mamak shop in the plush neighbourhood of Sri Hartamas a few years back? The mentality of these young men (the perpetrators are all young men) are disturbing to say the least. Have 50 years of independence and 20 years of Mahathirism produced this generation of young hooligans, whether they be supporting a cause or not, and whether they be children of VIPs?</em></p>
<p><em>I have a constructive suggestion: If they need to vent their violent instincts, perhaps they should go after elderly politicians implicated in crimes too heinous to mention for example, murder, and crimes of plundering the country&#8217;s coffers and crimes of fraud on the public. Why not band together to form an assassin squad? But, I forgot. These young people are too indisciplined to even form a team to watch football. All acts emanating from their concerted action are random and spontaneous of course.</em></p>
<p><em>And someone thought that National Service would instil discipline and unity in young people. Hopefully, National Service can be abolished after the minister in charge is no longer in Cabinet. The latest news (9<sup>th</sup><span> </span>Need I say more?  Anyway, I digress. August 2008) just came that some 50 NS trainees were involved in a brawl, with three arrested by the police.</em></p>
<p>Even more shocking perhaps is when a group of 300 protesters, all presumed to be Muslims, and led by PKR’s Zulkifli Noordin, Kulim Bandar Baharu MP, who is also a lawyer, threatened violence to end a forum on the rights of a non-Muslim spouse when the other spouse converts to Islam without his or her knowledge. It is a forum open mainly to lawyers and the speakers are mostly lawyers. It is merely a discussion on how to resolve the issue of a non-Muslim spouse being forced to accept the converting spouse’s rights to unilaterally convert their minor children to Islam and whether it is just that the converting spouse was entitled to go to the Syariah courts to obtain orders over custody, guardianship, property and maintenance despite his wife, a non-Muslim not having a right of audience in the Syariah courts.</p>
<p>Why this has inflamed the passions of some Muslims is hard for me to understand. Does this mean that some Muslims believe that once someone has converted to Islam, this person can then appeal to the Syariah or Muslim authorities to override the spousal and parental rights of the non-Muslim spouse? The impression one gets is that Islamic laws supercede all other religions in Malaysia and can be used to override the rights of non-Muslims unfortunate enough to have his or her spouse unilaterally converting to Islam.</p>
<p>Looks like it is now <em>Ketuanan Islam (Islam supremacy)</em>, and not just <em>Ketuanan Melayu (Malay supremacy) . </em><span> </span>I won’t be surprised if it is a PAS MP who had led the demonstrations which clearly was on the brink of violence, but a PKR man? Once again, our comfort levels are being jolted. We feel like we are being marginalized further and further.</p>
<p>Islam is the official religion under the Malaysian Constitution. Being official does not mean that when it comes into conflict with other religions, it overrides everything that that other religion subscribes to.</p>
<p>It’s just like the difference between the official or non-official news station of a televised event. The official tv station or sponsor may have more privileges, for example, extra coverage, extra time, and exclusive interviews with key participants. The non-official tv stations or sponsors still get the right of televising the event, but minus the extras. They still get the substantive benefits of what they paid for but minus the extras. Similarly, Islam is the official religion and gets priority like when the television stations air their prayers during each prayer time. In form, it has certain priorities but it does not have priority over other religions in terms of substantive beliefs. That is why non-Muslims can still practise their religion and do the un-Islamic acts of eating pork, gambling and drinking alcohol, notwithstanding that those acts conflict with Islamic teachings. <span> </span></p>
<p>The PKR MP then even had the gall to threaten the Bar Council against holding such similar forums in future with threat of “sterner action”.</p>
<p><span> </span>PKR MP cum lawyer threatening the Bar Council? I am beginning to fear that the cracks may soon widen into fissures at the rate these mind-boggling actions associated with PKR are unravelling each day.</p>

			<content:encoded><![CDATA[<p>It would appear that one of the most important documents that can shed light on the alleged sodomy act by Anwar is off limits to everyone - Saiful’s police report.</p>
<p>I thought police reports are public documents and any member of the public can obtain copies of them by paying the requisite amount at the police station where it was lodged. I wonder if denying the public the contents of Saiful’s police report is tantamount to abuse of the system?  Indeed, I would like to put here what the Deputy police chief  Ismail Omar told the <a href="http://www.nst.com.my/Current_News/NST/Monday/Frontpage/20080728173122/Article/index_html"><em>New Straits Times</em></a> newspaper after the spectacular expose of Saiful’s first medical report: “This is an attempt to sabotage police investigations and confuse people.”</p>
<p>Yes, Deputy police chief, the public is indeed confused. Perhaps, the Deputy police chief care to enlighten the public by explaining to them what the duties of the police are when conducting this type of investigations. Police accountability to the public has never been more pressing and needed here. Already, the Malaysian police’s credibility is in tatters. Maybe it’s time to educate the public on police investigative powers and procedures. <span id="more-19"></span></p>
<p>As far as I know, the first thing that the police always does is to suspect the maker of the police report. The allegations, especially such serious allegations, are always suspect and the police should query Saiful over his allegations. And examine the 2 medical reports. As well as why he met Najib twice days before he went to have his ass examined and made his police report following that. Further, why he met Senior Assistant Commissioner (SAC) II Mohd Rodwan Mohd Yusof in room 619 of the Concorde Hotel in Kuala Lumpur one day before the alleged sodomy took place.</p>
<p>Separately, a televised report of Najib explaining his (Najib) meeting with Saiful cast even more doubt on the real purpose of the visit. Is it really to ask for scholarship, as alleged by Najib? Bear in mind Saiful is a university dropout and Najib is NOT the Education Minister.</p>
<p>Shouldn’t the police inquire into Saiful’s background – his relatives (controversial blog – <a href="http://us3.malaysia-today.net/2008/content/view/10674/84/"><strong><em>Malaysian Today</em></strong></a> revealed that he is apparently the godson of a certain former Malaysian female athlete who is close to Najib’s wife, Rosmah. Investigate his connections with his outspoken uncle, Uncle Pet – who is he and what are his real connections with Saiful? Investigate Saiful’s financial position, mental state, his phone and SMS records. Basically, all persons who had come into contact with him and who knows his lifestyle, his likes and dislikes, for example, is he a known or closet gay? Talk to his  fiancée.</p>
<p>As far as I know, this is all part of police procedure when investigating crimes. Have they been adhered to? Before they even start investigating Anwar, who is innocent until proven guilty, they should have done preliminary investigations, some of which are detailed above.</p>
<p>Indeed, we, the citizenry, are very confused and hope that the authorities can shed some light on this sorry state of affairs.</p>

			<content:encoded><![CDATA[<p>It would seem from <a href="http://themalaysianinsider.com/index.php/headlines/42-lead-stories/2327-leaked-medical-report-fans-anwar-controversy">news reports </a>since yesterday that indeed the first medical report on Saiful Bukhari Azlan (aka The most talked-about ASS in Malaysia) appears to have some semblance of truth. The good doctor did indeed examine Saiful at 2.14 pm on 28th June 2008. And has allegedly come out with zilch sodomy claim by alleged victim.</p>
<p>How genuine is the medical report? The police have admitted that they had questioned the doctor early on during their investigations. The hospital has yet to come out with an official statement, although a representative had confirmed that the said doctor did examine Saiful. Bear in mind that the maker of the medical report, one Dr Mohamed Osman Abdul Hamid is now on an indefinite leave of absence.<span id="more-18"></span></p>
<p>The question now that should be on everyone’s mind is: What about the second medical report, purportedly conducted by a medical officer in a government hospital. If this is also in the negative, case closed. Why do we still need Anwar’s DNA?</p>
<p>Clearly, something is amiss. For the sake of rationality on behalf of our much-maligned police force, we will assume at this juncture that the second medical report has proclaimed that Saiful had indeed been sodomized. Otherwise, why the need to detain Anwar for his statement, and calls no less from the <a href="http://news.yahoo.com/s/afp/20080718/wl_asia_afp/malaysiapoliticsanwarhttp://">PM to give his DNA sample</a>? And mind you, prior to his detention, he was visited with a full SWAT team of 20 in Balaclavas in case he runs off to some sympathetic embassy like before.</p>
<p>Now that there are 2 allegedly conflicting medical reports over the state of Saiful’s controversial ass, we will need a third medical report to put to rest his sorry ass. As far as I know, it is not too difficult to find a willing doctor to write as per instructions from the higher ups. So, problem solved. All they need is Anwar’s DNA to corroborate the second and possibly later a third medical report.</p>
<p>Either that, or find the good doctor and make him recant his first medical report and do the <a href="htttp://www.malaysianbar.org.my/legal/general_news/bala_could_face_perjury_charge.html?date=2008-06-01">Bala PI </a>thingy. There are always options when caught in a bind.</p>
<p>A little note here: I have assumed, in the absence of any authoritative claims refuting the contents of the second medical report, that it indeed cries sodomy. Controversial blog,<br />
<a href="http://w2.malaysia-today.net/content/view/10433/84/">Malaysia Today </a>in their breaking news report yesterday had alleged that Saiful did have his infamous ass examined by another doctor at a government hospital, shortly after the first examination. And yet, the diagnosis was the same.</p>
<p>It seems whether he believes it himself or not, Saiful, according to doctors, is still a virgin ass.</p>

			<content:encoded><![CDATA[<p>I didn’t believe what I read in <em>The Star</em> newspaper (<a href="http://thestar.com.my/news/story.asp?file=/2008/7/15/nation/20080715180515&amp;sec=nation">15th July 2008</a>). The news seem to overshadow other unbelievable stuff that I have read in <em>The Star</em> over the years.<br />
I know Karpal Singh is against the Establishment, namely Mahathir &amp; cronies. And he is a long-time Opposition man. And wasn’t he the one who lodged a police report against Mahathir over the latter’s remark that some judges had approached him to lobby for their appointment <a href="http://thestar.com.my/news/story.asp?file=/2008/5/24/nation/20080524175446&amp;sec=nation">(May 24th 2008 The Star</a>)? But what was reported yesterday really had me thinking - what’s happening?</p>
<p>Karpal did the almost unthinkable. By calling for Justice Ian Chin to be sacked immediately over his criticism of Mahathir and further that “he (Ian) was not a disciplined” person, I had to re-read that. It had me seriously wondering about Karpal Singh’s state of mind. Whose side is he on? <span id="more-17"></span><br />
If the Star reporter had quoted him correctly, Karpal had said “I don’t want to have to use the word kurang ajar (ill-bred) but <em>judicially immature</em>,” he said, adding that the judge had been “narrow-minded” in his statements against Dr Mahathir. ”<br />
Hello … why such harsh criticisms against Ian? In fact, the majority of the legal profession is in favour of Ian Chin’s stand. The judges that deserve the description of “Kurang Ajar” or “<em>judicially immature</em>” are corrupt judges, as well as judges who compromise their principles by perverting the course of justice and convicting the innocent. Is Ian guilty of all that?<br />
Surely, Karpal has been misquoted?</p>
<p>Next, it was reported in the same article that Karpal Singh had asked why Justice Chin only revealed the 1997 boot camp episode now after Mahathir had retired instead of making the allegation then.</p>
<p>“Is it because Dr Mahathir has retired and one can attack him now?” he asked.<br />
“If a judge is scared, he does not qualify to be a judge,” Karpal Singh said.<br />

<p>Again, Karpal — weren’t you aware that those judges who judged without fear and favour, and spoke out against injustice, were sacked back then or earlier in 1988 ? Remember Tun Salleh Abas, and that unforgettable judge, <a href="http://www.malaysianbar.org.my/bar_news/berita_badan_peguam/rot_cloaks_the_judiciary.html">Justice Syed Aidid</a>. They had such a tough time. Both got sacked for speaking the truth. What about that judge who committed suicide by putting a bullet in his brains (Although the official reason was that he missed his recently demised wife too much, rumours had mentioned other causes). It wasn’t an easy time being a judge then with Mahathir and cronies breathing down on them with the threat of sacking and humiliation. Wish you had been a judge then, Karpal.</p>
<p>Sure, Ian might have put family and his pension first. It wasn’t easy. I am sure being schooled in justice and principles of fair play, he did not sleep well all those years. Which is why he mentioned that he needed to reveal all those things in order that he could sleep well after his retirement.</p>
<p>As I recall, judges are also human and sometimes, faced with difficult choices, they spend sleepless nights mulling over which side to decide for and against (that is, if they had not already been “instructed” as to which outcome is expected.) Some judges do admit in their judgments that they had spent sleepless nights thinking about a case that they have had to decide. But of course, this is because of the huge repercussions of their decisions. Sometimes matters of life and death are decided by them. Often, people’s entire future lies in their decisions. Judges are also humans who have their own flaws and prejudices, and individual beliefs and principles. I repeat: Judges are also human.</p>
<p>“If a judge is scared, he does not qualify to be a judge,” Karpal Singh is quoted to have said. If this is strictly applied, then some of Mahathir’s and the current Establishment’s appointees may not qualify.<br />
And if this is not enough, some MPs (in the same article) have called for action to be taken against judges who spoke out against some politicians, and in doing so, have sullied the reputation of the Malaysian judiciary system.</p>
<p>Wait a minute. Weren’t these MPs around when the Royal Commission of Inquiry on Lingam-gate (Lingam tape scandal) found the tapes more likely than not to be authentic? Surely, this already says something about the state of our judiciary long before Lingam-gate exploded into mainstream consciousness? After that finding, you have some judges and senior lawyers speaking out against the quality of the legal profession and judiciary in Malaysia.</p>
<p>Verdict: Something fishy is going on … I might have to dive underwater to find out more. One thing however is clear. If our MPs continue saying things like <a href="http://thestar.com.my/news/story.asp?file=/2008/7/15/nation/20080715180515&amp;sec=nation">aforementioned</a>, I worry for the citizenry. These are the very people who enact laws in Parliament. Small wonder that some Acts of Parliament (statutes) are behind time and do not address the current needs of the citizenry, in addition to being an instrument of abuse in the hands of a government.</p>
<h1 id="story_title">MPs criticise conduct of judges</h1>

KUALA LUMPUR: The conduct of judges came under heavy criticism in Parliament on Tuesday, particularly the recent statements issued by Justice Ian Chin, with some MPs calling for action to be taken against him or for him to be sacked immediately.</p>
<p>Debating the Judges&#8217; Remuneration (Amendment) Bill, Datuk Ibrahim Ali (Ind - Pasir Mas) said that it was not wrong to criticise the conduct of judges because it was the public that felt the effect of any judgment they passed down.</p>
<p>&#8220;The judges only administer the law. If they come up with confusing comments, why can&#8217;t we criticise them?&#8221; he pointed out.</p>
<p>Speaker Tan Sri Pandikar Amin Mulia interjected that under Standing Order 36(1), MPs should only debate matters related to the core issue of the bill and that this time, the proposed amendment did not touch on the appointment of judges.</p>
<p>&#8220;We are the two pillars of the government institution. We legislate while they administer the law. If we don&#8217;t trust their judgment, who else will?&#8221; he told Ibrahim.</p>
<p>However, the independent MP maintained that in his previous experience as a Parliamentarian, an MP was allowed to raise all matters during the debate of a bill at policy stage.</p>
<p>&#8220;If the judges have acted wrongly, who is to comment on their behaviour then? The statement by Justice Chin that he was sent to a boot camp has affected the reputation of our judiciary system.</p>
<p>&#8220;Can a judge make such a statement in the first place?&#8221; queried Ibrahim, adding that judges were supposed to adhere strictly to a code of ethics.</p>
<p>At this point, Dr Mohd Puad Zakarshi (BN - Batu Pahat) said certain judges only dared to voice out after Prime Minister Tun Dr Mahathir Mohamad&#8217;s retirement, asking that action should be taken against them for affecting the credibility of the institution.</p>
<p>Karpal Singh (DAP - Bukit Gelugor) also agreed with Ibrahim, describing Justice Chin as being &#8220;judicially immature.&#8221;</p>
<p>&#8220;I don&#8217;t want to have to use the word <em>kurang ajar</em> (ill-bred) but judicially immature,&#8221; he said, adding that the judge had been &#8220;narrow-minded&#8221; in his statements against Dr Mahathir and that he had had a petition against him forwarded to the Chief Justice on his conduct previously.</p>
<p>Later when he spoke, Karpal Singh said Justice Chin should be sacked immediately as he was not a disciplined person.</p>
<p>Karpal Singh asked why Justice Chin only revealed the boot camp dated back to 1997 now after Tun Dr Mahathir Mohamed had retired instead of making the allegation then.</p>
<p>&#8220;Is it because Dr Mahathir has retired and one can attack him now?&#8221; he asked.</p>
<p>&#8220;If a judge is scared, he does not qualify to be a judge,&#8221; Karpal Singh said.</p>
<p>He also said Dr Mahathir should act without fear or favour and name all the judges who had lobbied for their posts.</p>
<p>On the appointment of judges, Karpal Singh said politicians should not be appointed as judges and hoped that Court of Appeal president Tan Sri Zaki Azmi, who was a former Umno member, would not be promoted as Chief Justice.</p>
<p>Later, Pandikar Amin told Karpal Singh to read out Act 127 of the Federal Consitution and Standing Order 36(8) to remind the MPs not to debate on judges&#8217; behaviour again as it would be against the law.</p>
